Industry Categories

The United States Customs and Immigration Service (“USCIS”) EB-5 Immigrant Investment Program application requires that applicants specify certain industry categories on their application for Regional Center status.  As such, and due to the high tourism areas related to the Ozark Mountains Regional Center (“OMRC”) boundaries, we have designated the following industry categories:

As new NAICS categories are added to the Regional Center through amendment, they will be added to this list.  In the May 30, 2013 Policy Memorandum for USCIS adjudicators, the policy was set forth that regional centers do not have to do specific amendments for changes in geographical boundaries or for adding NAICS codes.  This process is now accomplished by filing I-924 Amendments for actual projects with exemplar I-526 Petitions attached.  By filing and receiving amendment to the Regional Center in this manner, “deference” (a presumption that the previous adjudication is compliant with USCIS rules and does not have to be revisited) may be accorded the new project so that developers and immigrant investors know ahead of filing actual I-526 Petitions that the project and the offering documents have already been approved through adjudication by USCIS.  Then the I-526 petitioner only has to deal with his/her personal information, interviews at the US Consulate, health information, and verification of legal source of funds, to name a few of the required items for adjudication of the I-526.
